If I understand this correctly, then First Select is inhouse collections, so they would be considered the original creditor. This would not fall under the FDCPA - it only covers outside collection agencies. You would have to dispute this with the Credit Reporting Agency where the inaccurate information appears, not with First Select/Providian. But it really has very little bearing on the situation.

I don't think you have a leg to stand on. My advice is to pay it, then deal with CRA's about the reporting. There are some folks on here who have broader knowledge than I do, perhaps one of them could speak up.

Lawyers?? Former collectors?? Board monitors??Anybody got any better advice?
