Yes, in Virginia it is also. some states have a separate Department of Consumer Protection.

As far as changing the original agreement, I'm not sure. I don't think they should be able to, but sometimes logic and law are not one and the same, you know?

My business experience is, that once you arrive at an agreement, it has to stay that way, or someone is in breach of contract; but, you have no written contract to refer to. It will take a lawyer to determine whether this constitutes a contract in your state. Logic says it is - but ask a lawyer. There are some that post here occasionally.
