I have credit card collections in my maiden name and in my name only. The accounts were established prior to me being married. I live in Missouri...If I am sued I have no job, no bank account, and I live in my husband's house(I waived my right to the house). So does anyone know if they can come into his house and collect his property for my old debt??? I have searched the internet for non-liable spouse and can not find any info on this. I am having a hard time trying to explain to people that in this state(MO) if I waive my rights to his home and he dies, this house goes to state probate court(unless there is a will). Many mortgage companies require a spouse to waive their rights to the property if they are not on the loan. This prevents any liens being placed on the home from because of someone other than the borrower. But I can not find anything on property contents. I still have 2 1/2 years before the state's statutes run out and I have not received any court orders yet, but I would like to be prepared. I do not think it is fair to take property from an innocent party.
