Hi Mike, If you'll tell me what state you are in I can give you better advice. I am an agent. First, get this stuff in writing. Send a copy of the bill, and a copy of your "Explanation of Benefits" (called EOB) showing where the account was paid by your insurance company in April. State the same things you just told us here - that you have a flexible spending account, and that you can no longer submit claims for the year 2000. Tell them it is their fault and you are not responsible for their billing problems. Then tell them that you want to know what they are willing to do to correct the situation before you file a complaint with the appropriate regulatory authority. Tell them that if they put anything derogatory on your credit file you will sue them immediately. Tell them they have 30 days to respond, or you will proceed with your complaints and/or legal action. Ask them to sign and return the enclosed agreement, in exchange for you not taking any action against them. Then enclose an agreement they can sign and return to you that 1)they will cease trying to collect this debt, 2)they will not sell it to any collection agency, and 3)they will not report it as a charge-off to any credit reporting agency, 4) that they will not report anything at all regarding this account to any credit reporting agency, also 5)that they will not send you a 1099 for "forgiven" debt. If you'll tell me what state you're in I will find out who the appropriate authority is for filing complaints. If you already know, then never mind, :) Linda
