Marilyn,

Don't despair, you have options.

Re: the Bankruptcy, I agree with both Linda and JJ. I'd add to JJ's comments that Congress has legislation that will make filing bankruptcy more difficult (pay something to creditors in Chpt 7), which is likely to be passed next year. If you delay filing for bankruptcy you may also jeopardize some or all of the w/c 'settlement' you may receive.

Bankruptcy attorney's give free consults - ask one if you have to disclose the w/c suit in the filing. If you do, that is a powerful incentive not to file.

All that said you have options. If the phone calls are from the Original Creditor: ask them to stop calling; get an answering machine; just hang up in their ear. If the calls are from Debt Collectors, you can stop such calls with one simple letter.

On no account tell either an Original Creditor or a Debt Collector that you may be receiving a settlement. Don't tell them anything at all.

As for medications, if your current program stops, you have options here too. Most states offer free medication programs. Yes there are some hassles and paper work but if you qualify it beats paying money you don't have or going without the medication, as so many do. If you do eventually have to pay for medications, don't pay full price at the pharmacy, order on line or purchase overseas - half price or less.
