Dru, So I am assuming it isn't a second mortage then? If my assumption is correct, then yes, you should file a lien against the property by bringing the existing note down to the County Recorder's office. There will probably be a small fee(10-20 dollars)to file the document. There's should be a template on how to fill out the document or the clerk could help you out. If the note doesn't stipulate that you will receive 6% simple interest, you might have a hard time proving that in court if the owner/beneficiary should dispute your claim.
