Yes, they are likely to put something derogatory on your report, and yes, they would be breaking the law. You can take them on if you have the determination, though. If you've read previous cases like yours on here (smart) you know there are laws that protect you, and if they break those laws, and you can document it, you can sue them yourself.

Read the Fair Credit Reporting Act and the Fair Debt Collection Practices Act - that's your guidebook.

The first thing to do is send them either a valication letter, asking for proof that the debt is yours, then take it from there, depending on what they do. Hope they break the law so you can sue ;).
