Thanks, Linda and JJ. On further perusal, the lawsuit says:

"Upon information and belief, defendant has lived outside the state of Texas ontinuously ever since 1990. Accordingly, pursuant to provisions of Texas Civil Practice and Remedies Code 16.063, any applicable statute of limitations is suspended during his [sic] absence from the state of Texas."

So THAT's how they're planning on getting around the SOL problem. It actually happens to be true, but how can they prove that? (I know, drivers licenses, etc.)

I'm gonna read that section right now. Any experience with this? Thanks in advance.
