HELP! Dispute with CC Company

I am having problems with one of my credit card companies and am wondering if a lawsuit is my only option. I am not exactly sure what you actually do, so I would appreciate a reply either way if you could help or not. This is the short version...just to get an idea if you can help or not...thanks.. COMPLAINT INFORMATION In February of this year I made a check by phone payment to this company in the amount of $100. The check # was 492. A few days later I received a letter from FCNB telling me that I had "written" a check to them on a closed account and that my credit card was being closed and I would be charged a return check fee and a late fee. I immediately called my bank and they had no idea why they are saying that because my checking account was indeed open and had more than enough money in it to cover the check. The bank actually said that check #492 was never presented to the bank at all. FCNB's "fees" caused my account to go over the limit, and everymonth since February I have been charged overlimit fees and a few late payment fees. I have made more than minimum payments on time every month since February, yet they still charge me these fees. It is not my problem that the rep from their company entered the checking account number incorrectly causing the payment to come back. They swear by the fact that their reps made no mistakes.
