I have been sued regarding a Sears account. It has been delinquint since February, 1997. I was sued in March, 2001. I made two payments on the account in late 1997, about four or five months after the account became past due. The attorney for Sears tells me that the statute is tolled (in other words doesn't start) until after the activity of me making the payments. I plan to see legal aid about this next week, but I am interested to find out if anyone is able to clarify this before I seek counsel.
