I shouldn't have been responding when it was late and I was tired. The statute of limitation, whether for reporting on your credit report or for filing a law suit, is based on the date of default. The date of default depends upon the state that you live in. In California, the default is not tolled because you make a payment after you have gone into default. Illinois, for example, considers the last payment made to be the date of the default.

Sorry that my previous post was vague regarding the sol as it applies to both situations.
