In most states you have to acknowledge the debt in writing. You would have to read the laws in your state to know for sure.

Are you talking about the original creditor or a collection agency. The original creditor would not be calling you on an out of statute debt, most likely - they would have already written it off.

If it is a collection agency and you know for sure the debt is out of statute, say nothing except "don't call me any more."

My best suggestion is never talk to collection agencies on the phone. Only deal with them in writing. They will (most of them) tell you anything. If they have to write it down, it is very different.

You do not have to talk to them.
