Is NC a community property state? If so the laws are generally pretty clear. You are responsible for your personal debt. You are also responsible for the "community" debt, and the "community" is repsonsible for your personal debt (the "community" is you and your husband).

If you have co-mingled your incomes, it is very hard to get around community property laws. Anytime you have co-mingled your money, whether in joint checking accounts or by paying community debt from your personal checking account, the funds become community property.

I sucessfully (in California) managed to keep personal property as seperate property on several occasions. You have to be very careful. My wife and I have owned real estate seperately. It involves being extremely vigilant about the co-mingling of your money.
