No, ignore that letter. Have they proved the account is yours? If not, they are violating the Fair Debt Collection Practices Act by attempting collection before validating. You can sue them and get $1,000 for each violation. So you should send them a letter telling them not to contact you again until they have proved that this debt is yours, or you WILL sue them.

Incidentally, you can do that in small claims court for a small fee, and you can include that fee in your lawsuit. At the rate they are going, it will be the easiest $1,000 you ever made.

Stand your ground. Don't be intimidated by their talk of a lawsuit. Don't give them any information yet. Make them prove this debt is yours first. You see, They probably can't prove it!! If they could prove it, they would!! You have most likely won the first round. Look in the links on the left of this page. Under credit laws, read the Fair Debt Collection Practices Act.

This collection agency is NOT collecting FOR your credit card company, they have purchased this debt for pennies on the dollar, and are making your life miserable trying to make a profit on it. They are parasites. Your credit card company has written this debt off already - a long time ago.

Don't let them intimidate you. They cannot do anything to you now unless they prove this debt is yours. You can make them go away. Don't give in to their tactics.

Linda
