No, the bank that issued the card is the original creditor. However, generally speaking, you can still use the same laws. It's just that your chances of successfully avoiding paying the debt are much less when you are dealing with the original creditor. About 6 months after you default, the original creditor will write this off and then you will be dealing with third party collectors.
