is an isp a utility and can they use a collection agency?

i had a charge reversed by my credit card company for an isp which sold me an unusable modem and the company they are an agent for ceased operations. therefore i couldn't use the modem or the service.

my question is
a)can they utilized a collection agency
b)can the agency report any action to the credit bureaus regarding this situation

i don't want my credit history to be tarnished over 153 dollars which my credit card company backed me up on determining that the company misrepresented themselves
