collection agency

A collection agency has file a lawsuit against me for a credit card charge that is not listed on my credit report. I contested the charge and responded to all their interrogatories and demanded to see copy of the signed contract. Since they couldn't provide that document, the collection agency has now sent me a "Stipulation of Dismissal" letter for me to sign and mail back to them. Should I do this or should I sue them for fraud?
Thanks,
Blufo
