You're saying the summons has his SSN and old address where it was served, but that this is not your SSN or old address, right?

And the SSN the credit bureau has on your report is yours, right?

If this is the case, then you send them a photocopy of the summons and any other paperwork you have from the court, with the court certification showing (where they can see it) and tell them take that record off your report immediately or you will sue them for malicious misreporting and defamation of character. Give them ten days from date of receipt of your letter, send it certified, return receipt.

This is caled a "letter of intent to sue." You want to keep your copy, and the receipt and little green card you get from the post office. Then if they do not remove it, you go down to small claims court and sue them for violations of the FCRA. (go read it if you haven't already)

Suing them is easy. get my email in case the board goes down again and you need help with this.
