I am in Illinois. I was having trouble paying and had not made a payment since this year September...the lawyers office said they got it in October. I have not made any payments since September this year. I had been sporatic with my payments over the years, making them mostly but would not be able to for a few months, then start again. Sears never answered any of my letters when I would send them with partial payments. The lady representing the lawyers said the creditor WAS helping me by allowing me to make payments rather than owe the whole amount. All credit cards actually HELP people by allowing them to buy expensive items and pay back a small amount at a time. She said by me making payment arangements now I would not have to go to court. The letter to stop calling me at work was faxed to them. They called 4 times after I sent it but I have no proof...that is the problem. The only proof is how I got into trouble at work for being on the phone! To all people listening...send letters certified! Keep ALL copies of letters sent! Keep records of times and what was said on the phone, tape it if you have the ability. I have learned the hard way. I called today to make payment arangements. They say I owe $3445.00 which is about correct. I wonder how much of that they get to keep!
