A few more questions please?

FYI - the lawsuit should cover the bills, the lost wages, compensation (suffering), future cost for plastic surgery, and lawyer fees. So far their only offer was compensation/future costs to be paid when he turned 18 and/or 21, etc. The firm had a fit. Heck, I had a fit. I couldn't believe they weren't also planning on paying the out of pock amounts we've paid already and are still being billed for, not to mention enough to pay for my loss of income and the lawyer fees that "they" of course would want NOW, not 12 years from now. Too wierd! The senior partners are now involved now that our lawyer has moved out of state, we've moved out of state, and this has gotten out of control. Techinically his twin brother suffered too, so I feel like they should compensate for his pain as well. But at this point, I would almost settle to just enough to pay the bills and lawyer and be done with it all.

BK Questions:

If we file a chapter 7, we still owe the remaining balance on the van right (reaffirm)?

Can't the loaning bank reposses it since we have yet to pay it off (if we don't reaffirm)?

And are we allowed to reaffirm the van, rental home, and one furniture account we still own on, under a chapter 7?

I guess I was under the impression under chapter 7, that you were not allowed to reaffirm anything at all?

And should I send certified letters to everyone now, telling them we are filing on Monday, or should I wait and send the letter out after I file with a court filing number included in the letter?
