A statute of limitations can be re-started in the following different depending in which state reside:

1. California - only if the promise is in writing. A mere payment alone CANNOT extend the Statute of Limitations. Be careful not to write a promise to repay further payment on the Memo section of your check or anything that may be inferred as a promise.

In other states, a mere payment can prolong the statute of limitations (SOL).

Check with a local attorney or go to one of the legal websites.
