Yes they can take your refund, make sure you file your IRS Tax Return 1st, get the check, and then file BK. You can also get a home mortgage as soon as 1 day after your BK is discharged (higher interest and down of course) normal rates and down pymts after 2 years. I worked for an attorney for several years and have gone through this agonizing challenge my self. This year it will be two years. It is amazing how different creditors pick and choose - example I couldn't get a loan for a new boat (pymt 150/12 years) vs new motorcycle (pymt 420/6 yrs). But anyway credit cards you pay more for, interest rates are higher but I wouldn't change anything. It was definitely a blessing and a huge relief.
