I am being sued for a charged off [in 97] credit
card.I searched all over the Web and the best I
could read Arkansas's Codes on SOL on Debt and it
is 3 years. So I filed a Answer, Affirmative
Defense,Statute of Limitations expired with the
court and copy to Plaintiff's Attorney.and I sent
copy within 20 days I was given.This was in
October.In December I received a letter in mail
from Plaintiff's Attorney saying enclosed Motion
for Summary Judgment they have filed with court on
12/11/2001.Dec.28 I was delivered a registered
letter from the court telling me date of court
[Jan.27,2001. To hear arguments for the motion of
summary judgment,filled in this court Dec.14,2001.
The only thing I have on my side is my credit
report that shows charged-off revolving account
and last activity date 4/1997.[their complaint
showed last active date 4/1998]Can I walk into
court with just my credit report?I don't know what
to do now,have any sugestions ? Oh yea Plaintiff's
Attorney is from the same state I'm in Arkansas,so
why would they continue this case,they would know
more about SOL than me.Please let m
