Sorry, I missed you answer. For some reason my browser is marking items "read" when they are not.

I am in Virginia too. :) Yes they have to take you to court to get a judgment. First they have to "serve" you - that is send you papers that say what you are being sued for and when and where the court date is. If you do not go, they win automatically, and there is a judgment against you for whatever amount they say you owe.

If you show up, you can make them prove that this is really your debt - lots of times, you'd be surprised, they can't!!

There are a lot of things you can do.

How long ago did you default on this debt?? This is very important!!
