Is this true? I've heard of people doing this to keep it out of court and having it work. The idea is that a judge will dismiss the case and not grant a judgement if you can show that you're making payments, even small ones, because it shows you are doing what you can to try and pay the debt. My husband has a credit card with a local collection attorney and has sent them a validation letter. It's been a week and we've heard nothing yet. We're hoping they can't validate it since we can't afford to pay it at the moment. It really makes me nervous that they're so close and I worry about him getting sued. He hasn't made payments on it for 3 1/2 years.

I'd like to get the other cards we have paid down and then take care of the stuff in collections. I thought that if they did validate, we could start sending them $25 a month, occasionally sending more when we had it and slowly get it taken care of. I know that $25 won't help the balance much, but we want to avoid a judgement against him.
