Your lawyer is correct
"It clearly states under terms and conditions that, "this offer and any resulting account are subject to Delaware and FEDERAL (my caps) law."
If your lawyer is a expeienced with the Federal FDCA and has had experience in the subject he would not have needed to call a low level clerk in a bank in Delaware who's information on POS is inaccurate. Go to the Delaware Bar association website (where I copied the POS information from) and check it for yourself.By the way, and as a point of information, your REAL concern on the law should be as to what danger you are in from a judgement in your State, some States. like Florida & Texas give almost complete immunity from liens and garnishment. Get a lawyer who knows what he is doing.(the idea that this site is a conspiracy by credit card companies is ludicrous,and in my opinion only an incompetant lawyer would suggest it to mask his own lack of knowledge)
