Beth, I would write Merrick Bank a real serious sounding letter, saying that as AU on this account, you are not responsible for the payments, and tell them they must delete this derogatory entry from your credit report, and make sure they never report this account again, or they will have to "deal with the consequences." Tell them you know your rights and the law, and that you won't hesitate to "take forther action." Send it certified return receipt. Send copies to the credit bureaus that are reporting this account, with the same kind of vague but threatening warning. Keep you little green receipts from the post office, in case you need them later.

That should do it. There have been lawsuits over this type of thing, and they would lose in a court of law.

The next thing is to tell the family member to please have your name removed from that account as AU. They may be embarrassed, but hey, it's not your debt, and definitely not to your advantage to be on this account any longer. If that family member takes bk, that could end up on your report too!!
