I had a medical bill with my local hopsital that I became default on. In the beginning it was just my account in my name and then my husband incurred a bill with them also. They were sending 2 different statements each month so I requested that his amount just be put on my bill as we are married and the due dates were the same and I would just send in the payments in one form of a check. I was unable to make payments on this for 3 months after it was sent to the collection agency as hubby became unemployed and no interest was placed on this account so the house pymt and interest accounts we top priority at the time. The hospital sold and immediatly they threw a judgemnet on me in my name. I was served papers with a court date. I called the attorney represnting them and we agreed out of court for me to make payments of 50.00 a month, which I have done and have kept current. From the date of the judgement they have started charging interest of 9% on this judgement which was placed on me on 2/01. My outstanding balance was $789.71. They are also charging me past due interest of 348.94. When I questioned them on the interest why it was on the account when none had been on it prior when it was in the hands of the hospital and the collections dept they said something along the lines of -"becuse we can".But they are charging it from the date of service on the payments I have already made!!?? Can they do this on the back payments I made that I did keep current? Nothing was said at time when I agreed with them oer the phone to send $50.00 a month about interest being on the account. I have then since found out that my payments are applied only to the interest and not to my actual debt and will continue until the interst is paid. How is one ever to pay off something when it is only being applied to interest that accrues daily? Also,my husband only(not I) is thinking about filing chapter 7 on some really high cc balances. Is
there anyway to place "his part" of this judgement on me in his bankruptcy case if he does file?? I know this is long but thanks for taking your time to read and answer my questions throughout it. :)
