The estate was never probated due to the condo problem. However, it can be probated on a simple basis since there was no real estate other than the condo villa. The bankrutpcy attorney said that while probate takes a few months, I would have to wait a year so it doesn't look like tranferred propety was done as a way to get around expemtions and things like that. He felt that by just leaving it in my name, which is homesteaded but no deed, the bankruptcy trustees can catch this and claim it as an asset, not my property (even though it is). Thinks it's a gamble to proceed this way. I don't know at this point. Just wanted to get it done but now I can't.
