While you could file suit you have to consider this can be a long drawn out process. You could demand the court vacate the notice of suit. Clearly, you have the documentation of agreement in your corner. And as has been stated on this board - time and time again - all communications should be done by certified, return receipt mail - NO EXCEPTIONS!
