On Thursday (2-7-02), my husband and I received a call from a collection agency in MA. The gentleman indicated on the machine, “ My name is Jack W***, with Kendall ***Call 1-800-***-***.” We were dumbfounded as to why a “FIRM” was calling us, so we immediately called back but the office was closed. Well, then today (2-8-02) my husband called the 800 number to find out the status of this message. Come to find out, it’s a lawyer, supposedly, with a collection agency saying that my husband has been delinquent on his credit card payments with a particular retail store. This information is true in regards to this one account BUT it was back in 11/96. It’s on his credit report, which will be taken off in another year. So…my question is this. The “lawyer” with this collection department has stated to my husband that if he doesn’t pay the full amount by Monday 2-11-02 that he will be taken to court. They are also being SO GENEROUS (exaggeration!) by saying, “if you pay this by Monday we will lower the due amount by approximately $250.” This is the first time this has happen to us! Is this all true….can a collection agency take him to court for something that has happen nearly six years ago and the length of time that has passed?
