They are entitled to try to collect from you,however they are past the time when they can legally sue. Write the letter to the court in response as I said,if there is a hearing set,just show up (don't be afraid) with your records that shows when the account was defaulted and charged off. Also add to the letter you are sending a copy of something that shows the charge-off or default date,and state you have been available for timely service continuously from that date. Request a dismissal of the case.You may still have to appear, but I doubt it.(when you send the copy to the lawyer,include a separate letter to them requesting they cease and desist from all further collection efforts.Make sure you keep copies of EVERYTHING and send return receipt.
