You had best sit down with a BK lawyer in your own area,(State) in general,a ch.7 is better and allows you to keep your home and vehicles,(reaffirming the mtg.and truck note) The 401K loan may be a problem in a ch.13 as you can't give unequal treatment to creditors.If you default on that,without the protection of BK,you are talking about risking losing a lot more and having garnishment besides.You may not qualify for either ch 13 or ch 7.That is why I say see a good BK lawyer for advice.
