It is the providers responsibility to submit the bill to your insurance carrier, if you gave them assignment rights (I'm sure you did).

The bureau of insurance doesn't really regulate this, but your state's AG might take an interest in it. Depedning on the amount of money, you might consider suing the Doctor's office for not filing. (I hope he isn't a doctor you depend on for medical care, though. If not, it would probably get them to settle with you by having the entry on your credit report removed.

You can go on your own back to the Dr.'s office and try to make them file, but chances are, the insurance company refuse to pay, and will say it had to have been filed within a year of the date of service.

I am going through this now with my dentist's office - they didn't file correctly, the claim was postponed, pending more information from the dentist. He never sent them the information, so they never paid. Now they are trying to collect it from me. I went down the and told her exactly what to do, and she did it her way instead - they refused to pay again. She called me to come down and pay the bill. I got my lawyer on the phone with her in a conference call. :) I am waiting now to see if she managed to get it right this time.

Just a word of warning - keep track of the bills and the EOB's (explanation of benefits) for medical treament. Medical billing is almost always screwed up, and you are the one who takes the hit.
