The statute of limitations is a DEFENSE that must be raised if you are sued, as there are circumstances (tolling) that might limit a SOL defense. The laws on checking account overdraft or bad checks vary from State to State,if a bad check account is turned over to a regular collection agency,then there is some protection under te FDCPA,however an overdraft debt is outside of any credit or debt consumer protection laws that I am aware of.
