On this and many other web sites I read that 3rd party collection agencies CANNOT sue me as long as the debt still belongs to the original creditor. Please assist me in finding the basis in law so I can stop this lawsuit or at least a defense to take to justice court. Here is a brief summary of what has transpired so far. I requested validation some months ago and they promply sent me a copy of the application which I signed and a copy of their computer print out...All which is not proper validation, right? Before I could get another letter sent requesting proper validation, I was served a summons. I answered and made proper request for documents to the attorney representing the collection agency. They did send me a copy of the assignment of the debt and some of the statements of the account and once again, only the application which bears my signature. They have not yet sent me the complete contract , ie Cardholder Agreement. The court date is March 18, fast approaching. I need to be pointed in the direction of the law that precludes the 3rd party collection agency from suing me. Any help you can give me will be greatly appreciated. I live in Montana.
