I do not know where you read that 3rd party Collection Agencies cannot sue on an assigned debt. It is true, that many States prohibit it, and many others place very strict limts on how such actions can be carried out. Montana, is one such State. I have given you the link that spells out the requirements. If you respond to your lawsuit with a request for the documentation that is required to effect the lawsuit,you should have an opportunity,since you say they did not prodce full validation documentation. You also have a claim under the FDCPA for their filing the suit during an unresolved dispute.
