I don't think you read that information on this board. Third party collection agencies can sue for the debt. Anybody can sue anybody else for anything. The question is, can they win? And do you know your rights in your state?

Unfortunately, if you do not know your rights, and you don't get an attorney who knows your rights to represent you, they can and do sue and win, even when the law is in the consumer's favor.

Sounds to me like this collection agency knows what they are doing. You had better get legal counsel, IMO, or you are going to lose this one.
