No, you already sent a C&D. Put the letter in your file, in case they sue you. Then you would have to go to court.

One of the problems is that, that you just about have to be willing to file against them to back up your arguments that they are violating the law. However, if you would rather wait until they take you to court (if they do) - your choice. For that you get no omeny, For filing yourself, you get at least $1,000 and court costs, if you persist and prevail.
