You ae absolutely right. Send them a "letter of intent to sue" if you want to be nice about it - gives them a chance to back down. Then file.

Or just go ahead and file. Small claims is easy, made for ordinary people. I think you would get an easy $1,000, and they would have to delete this from your credit reports. If they call you and make an offer to settle (they will), check with us before you accept it. There are some bases you want to be sure you have covered (like selling it to another CA).

This must be a decent amount of money, or a 2 bit collection agency, to go to all the trouble they've gone to!!
