Not exactly true. When I got divorced my wife kept our joint account in her name only (this was part of our settlement) I opened a new account at a different bank. Maybe it depends on the state or the bank. Your wife cannot be arrested for not appearing...but she can have an automatic judgement against her if she doesn't. Also, and I may be mistaken because I've never been sued, I believe a summons MUST be delivered to the person who is being sued not their brother or anyone else. Not only is the ammount low to be sued for but one year seems a bit short. Usually they try to get at you through a collection agency or something first.
