We go to a lawyers today to find out what we can do about a past debt. The Debt is an old car loan. The car has been gone for some time.. repoed in 1997. They auctioned it off and we still owed a balance. We paid on the loan until we stopped getting contacted by mail and phone (1998-99 not sure) Gulf State bought the account in 1999 and have sat on it for the last 3 years. They sent a letter to my mother in law's house (who has moved twice in the last 6 years) We have not moved in 10 years. Why did they send it to her??? They said that they did not have our current address. My husband and I had separated for about a year, 1996-1997. Gulf Credit had that residence as the last known address. However, he moved back into our home and continued to pay on the car loan. The company knew of his address changes and phone number changes from that time. So I guess my questions are..
1. when is the SOL on this loan up?
2. what are the possiblities that they can validate this debt?
3. Can they really be serious about suing us when they are in GA and we're in PA?
4. They had offered a settlement of about 70% less, but then said when they got our credit report that they wanted the full amount or they would sue us and we would incur all expenses. Can they do this?
5. They mentioned that they were going to contact my husbands employer, isn't that a violation? Just to threaten to do so?
Thanks in advance...
Linda
