You are in luck,Maryland is not a community property State.Since you were still married at the time it will be somewhat more difficult,did you have a legal separation in force?Try this: write to Sears, DON'T CALL. Say you are disputing the account under Maryland's Statute Of Frauds and the Federal Truth In Lending Act. State you did not sign for any "new" credit at Sears, that you demand they investigate the forgery of your signature and cancel any charges illegally and fraudulently placed. State that you will cooperate with their investigation, BUT only if they withdraw their claims against you.State that if they persist in abbetting this criminal forgery you will file suit against them,send it registered return receipt with a copy to the Fraud division AG's office of Maryland.Do not refer to your ex-wife in this letter,just whatever account # they are putting on their bills to you.Basically,what you need to do is act as if it was a total stranger who did this and forged your name to the application.
