OK, Short version- I defaulted on a Citibank credit card over 6 years ago due to fact that my husband and I split and at the time we lived in Maryland. We reconciled and relocated to Georgia. It took a while for me to get a job, etc., etc.,. In July of 2001 I received a "Letter Of Complaint" with a civil case number on it. Citibank attorneys are trying to collect about $9000.00 for the debt, fees, etc.,. I called the courthouse and they said that an answer needed to be filed within 30 days. I did this with the courts. I received a carbon copy letter (March 2002) from the attorneys (nothing else prior to this) stating to the clerk of courts, asking that there be no hearing and request that a judgement for this amount be granted. After I received this "Letter of Complaint" I did seek some legal council and they said that the SOL (4 years) had past for the state that I lived in (Georgia) and they also stated that it didn't matter where it was open it goes by the state you are presently residing. They also told me that it doesn't mean that I didn't owe, it just meant that they couldn't collect on the debt. Is that true? My dilema is how or what do I do about not getting the judge to grant this judgement? I would go to court and explain my situation to the judge if I had too. I can't afford to repay this debt and would not like to have this judgement against me because I also have direct deposit. I need help fast because the letter is dated to the judge -March 18,2002. Can I type a letter to the judge on my own stating the SOL and disputing this action? Will the judge immediately sign for the judgement or do I have so many days to comply? Will I be notified about a court hearing or do I have to request one? I do plan on seeking an attorney, but I still would like some input from you guys out there on this situation. If this judgement is granted I plan on filing bankruptcy immediately. Will this stop any type of garnishments? Thanks ever so much. Need Help Fast!
