I started looking at this board several months ago. Sometimes, late at night, I read some of the questions from people. A few times, I have responded to their problems. However, I don't have the hours and hours that Why Chat seems to have to devote to giving advice. I also have no desire to engage in a battle of who's right. I posted the statute, and you read it yourself. I really thought that that would end the conflict. It is well established law and their is no defense when a coporation uses a name other than that which the debtor knows as the original creditor. It is important to document, as you are doing. Good luck with establishing a case for yourself. Because I find the coincidence so amusing, I must tell you that I got a call from someone today and...guess what...the debt collecter is First Select. They bought a Discover card debt.
