It is true that if your account was "turned over" to First Select it would seem as if they would fall under the FDCPA,however, the specifications in the act are VERY clear. Unless First Select was operating as a collection agency it is not included. Many cc companies and banks transfer accounts to subsidiaries for administration, which includes processing charges and accepting paymentsof ongoing accounts. This means they ARE NOT a collection agency.Now, if they ONLY handled "collections" and no ongoing cc accounts, our pseudo Cal. Atty. would be correct and they would have HAD to respond to your FDCPA request.
