First Select falls under the FDCPA. I think you owe Cal Atty an aplogy.

The issue was never whether or not the FDCPA "applies" to the original creditor. Rather, the issue was whether or not First Select is "considered" the creditor for purposes of the act.

I think it has been sufficiently established that the act applies to FS.
