The site linked below is from the Illinois Legal Aid, perhaps your lawyer will find it easier to use their information rather than do the proper research himself. As Razor said, the TILA clearly defines credit cards as OPEN accounts, even if they are signed in blood! It is the FORMAT of the account that determines if it is "open ended" or "closed= contract".
