"harrasment" from Wells Fargo Bank

I was in a partnership back in 1985 , during this horrible experience ,(7 months) Since my partner used all the money on personal gifts for himself we had no money to pay the employees so we both went and got a businessline for $50.000 My deal with the bank was that we should get checks with 2 signatures and for me to give approval of any withdrawal...well somehow my partner managed to get by all my wishes and he starting withdrawing the money in one month he took all the money out for personal use...I didn't know what to do I confronted him and nothing happen so I told him that I will go to the court and "dissolve " the partnership.. which I did and Also send letters to all the creditors and the bank telling them that I was not responsible for the debts that my partner had created... I took my files and lost all the money I had invested...he swore that he would pay the businessline. I called many times the bank and they never wanted to talk to me... only to my partner...??? on top of that they were rude to me.. The years went by (almost 7 ) and now I get a letter from Wells Fargo Bank telling me that all the efforts to resolve the delinquent status had failed (never received a call or a letter) and if I don't pay by May 1st 2002 the sum of $38,150.60I I will be assigned to their attorneys or collection agency to pay the balance on full
and in addition I will be responsible for the court costs etc,etc, as stated within the terms of the businessline agreement.
Well , I don't have that kind of $ and on top of that I know that I wasn't the person that used that $ and the bank knows that....but they are desperated to get their money back...Can I defend myself with the statute of limitations? Can I defend myself that the bank did not provide the 2 signatures agreement? ... I still can't believe that NOW they want my money when before they wouldn't even talk to me..
