Newbie here. Excellent forum--have spent countless hours reading here and elsewhere, and am ready to begin tackling the first of my "3 negatives". I would appreciate any help/advice with this situation:
-Sears account for total of $744, became delinquent (7 year clock started in 7/97)
-sent to atty/CA in early 2000, who threatened me with suit/judgment
-being young(er) and ignorant, I took a 50% settlement offer with them that would "prevent me from going to court" and the debt would be reported to my creditor as paid in full
-they tacked on $200+ legal fees, so basically I paid $450
-come to find out that Sears simply deducted the $450 I paid to CA from the 744 and now reports that as a past due amount from 10/2000!? Furthermore, they still list the account as a charge-off, but they have about 5 different charge-off dates (7/97-6/98,10/98-5/99, etc) What the heck does this mean?? How badly did I screw up paying the CA?? Of couse the CA has no copies of information, but they do have all of the info and dates pertaining to my '50% settlement' in their computer and I have recorded two phone conversations in which they verified all of this payment information completely with correct dates and amounts (fortunately, no 'wire tap' law prohibits this in Arkansas!) But they stop there and say--"deal with Sears, we don't deal with credit reports, we just do our job"
How should I tackle this animal?? Heck, I'd be glad to pay Sears the addt'l money just to get this over with, but now, I've become curious about the SOL (3 years in Arkansas). Negotiate? Validate? Any and all advice would be greatly appreciated.
